Compliance and Equity Investigator

The Compliance and Equity Investigator (Investigator) reports to the Managing Director of Compliance, who has primary responsibility for ensuring schools and school staff follow all applicable laws and regulations, as well as all network policies and procedures, including the harassment, discrimination, bullying, and Title IX policies. The Investigator assists in resolving complaints of sexual misconduct, sexual harassment, harassment on other bases, protected class discrimination, bullying, and retaliation involving students at all BASIS charter schools, as well as providing consultation to schools and staff members dealing with compliance and equity issues. The Investigator will work closely with the campus policies noted above to conduct investigations of complaints filed by students and/or their parents. When a complaint is filed, the Investigator will conduct a prompt, thorough, and equitable investigation. The Investigator acts as a neutral party in the investigation, gathers and reviews evidence, evaluates credibility, makes findings and recommendations, and provides a detailed, unbiased report regarding the results of the investigation.  The Investigator will also assist in training school and office-based staff on compliance with applicable laws, policies, and procedures, as well as the investigation process.

Job Responsibilities 

Investigation & Consultation

1.       Receive complaints of bullying, harassment, discrimination, and other violations of the Student Code of Conduct or school policy, including all areas covered by Title IX and other applicable laws, and identify relevant policies and Code of Conduct provisions. 

2.       Exercise judgment regarding the resolution of complaints including implementation of interim measures, consideration of informal resolution options, determining the necessity of a formal investigation, and the imposition of disciplinary outcomes.

3.       Conduct a prompt, equitable, and impartial administrative investigation into complaints including identifying and interviewing parties, gathering and assessing information relevant to the conduct and allegations at issue, applying relevant policies and laws, and making findings of fact in individual cases. 

4.       Actively foster and maintain a climate that is supportive of students and respectful of their differences.

5.       Provide information to students, employees, and others regarding the Code of Conduct and network policies, and provide consultation to schools regarding compliance and equity issues.

6.       Research, analyze, and summarize compliance requirements across the network and provide information to schools to implement compliant practices.

Community Outreach & Education 

1.       Create and facilitate training/presentations to students, employees, and others regarding the schools? nondiscrimination policies and identifying and integrating best practices into the school and the complaint resolution process.

2.       Cultivate relationships with school stakeholders (e.g., students, employees, parents, and others) and maintain clear lines of communication.

3.       Collaborate with on and off campus resources, including law enforcement and victim services, in resolving complaints and work with various company divisions to ensure that the schools? processes, responses, and policies are consistent with federal and state laws and regulations related to compliance.

4.       Stay abreast of current movements in the field of student conduct investigations by participating in professional associations, attending conferences, building relationships with colleagues at peer institutions, etc., and continuously identify and integrate investigation best practices into school policies and practices. 

5.       Review current literature, conduct research, and summarize key components of compliance and equity initiatives and requirements that impact K-12 schools.  

Minimum Qualifications: Bachelor's degree and two years of professional experience from which comparable knowledge and skills can be acquired. 

Competencies/Knowledge, Skills & Abilities: Excellent judgment and the ability to manage highly sensitive and confidential information. Strong skills in the areas of conflict resolution, problem solving, interviewing, and conducting thorough inquiries into complaints and issues raised. Strong analytical skills and the ability to assess and negotiate complex and highly sensitive situations. Exceptional critical thinking skills demonstrated by the ability to analyze information, evaluate consequences, and facilitate resolution of difficult challenges.  The regular exercise of professional judgment and decision-making including the willingness and ability to make credibility determinations and substantiate conclusions.  Sophisticated logical reasoning and ability to synthesize information and provide strong written analysis in a clear and concise manner with a high degree of accuracy.  Ability to maintain neutrality, work under stress, and maintain a calm, non-judgmental attitude and demeanor at all times. Demonstrated commitment to diversity and success in working with diverse populations to support an inclusive school environment. Strong and effective interpersonal skills including the ability to listen well, effectively communicate verbally and in writing, and demonstrate sensitivity to and respect for individual needs. Ability to work as part of a network-wide community to resolve complaints in a neutral manner. Ability to establish and maintain professional and productive working relationships with staff at all levels network-wide. Working knowledge of nondiscrimination laws and compliance regulations including Title IX, due process protections as they apply to student conduct in a public school setting, confidentiality and privacy laws, etc. 

Preferred Qualifications: Juris Doctorate degree or Master's degree. Experience in student conduct or an office of discrimination and harassment is highly preferred. Experience working with K-12 students. Professional experience conducting investigations in a K-12 setting. Knowledge of complexities surrounding investigations in a K-12 setting. Title IX Investigator or other similar training certification.
